[EN] COMMISSION: REFUGEE PUSH-BACKS ARE ILLEGAL

EU warns refugee push-backs are illegal | EurActiv

The European Commission indirectly warned Greece and Bulgaria today (19 November) to stop turning down Syrian refugees at their borders with Turkey, after the UN issued a similar call just a few days before.
The UN High Commissioner for Refugees (UNHCR) António Guterres called last Friday on Greece and Bulgaria to stop turning back Syrians fleeing their war-ravaged homeland.
Bulgarian authorities have reportedly bragged of turning down refugees at the border.

Syrian refugees arrive in Jordan. Some carry belongings, others carry children.

In the afternoon of 12 November, UNHCR received information that around 150 Syrian refugees, among them many families with children, were being held in police custody in the area of northern Greece, after crossing the Evros river earlier that day. Members of the group of refugees, as well as persons claiming to be their relatives, reported the presence of some 70-80 persons in the yard of a church in Praggi village, near Orestiada, and of another group of 80-90 persons in a near-by forest.

Following communication with local police authorities which could not confirm the facts, a UNHCR team visited Praggi, during the early evening hours of the same day. The team was informed by eye witnesses that a group of about 80 foreigners, previously at the village’s church, were seen taken on police vans to unknown destination.

4.5. Push-backs from Evros Region

The land border between Greece and Turkey runs along the river Evros, except for a section of land, where a fence has been built. In the Evros region the Greek army, the Greek police, the border police and Frontex units operate. The area is also monitored with thermal cameras and other high-tech equipment. A military border zone exists, where access to civilians is forbidden.

Most interviewees claimed that they were either arrested after their entrance in Greek territory via Evros River and while walking in the streets of the first villages they saw, or in the woods where they got lost or hid themselves. In some occasions, refugees claimed that upon their arrest they were made to  believe that they would be taken to a detention center.

‘We hid for two days in the woods. (…) At six o’clock in the morning four persons came. (…) They had guns and radios. They woke us up with punches and
kicks and asked everyone who had a mobile phone, to put it in front of them. They put all the mobiles in a plastic bag. They waved us not to talk. [’97]

At first, the drowning men and women were mistaken for seagulls. Early Thursday morning, local yachters off the southern Italian island of Lampedusa still had no idea that a ship carrying some five hundred African asylum seekers had just gone down in the water nearby. Hearing high-pitched cries, they looked out to sea to find that the source of the noise wasn’t birds (as they’d first assumed) but Eritrean migrants shouting for help, their bodies thrashing. A large portion were women and children fleeing conflict and poverty by way of Libya, only to be hastily drowning, within eyesight of the Italian shoreline, in the same waters they’d hoped would rescript their lives.

Lambedusa is just one

Italian rescue crews are still pulling bodies from the water from Wednesday’s shipwreck, after a 66-foot boat packed with some 450 men, women, and children caught fire and sank in the Mediterranean. At least 111 people, mostly migrants from Eritrea, Ghana, and Somalia, drowned. Another 200 still are unaccounted for, according to Italian authorities. It is one of the deadliest of such crossings on record — but then, records are incomplete.
“No one knows how many wrecks there are that we haven’t heard about,” says Italian blogger Gabriele Del Grande, who tracks news reports of migrant deaths. “Only the families of the missing know. From Morocco to Sri Lanka, they will spend years wondering what happened to their children who left one day for Europe and never returned.”

ROME — Having floated for at least two days in the choppy Mediterranean Sea to reach Europe, a rickety trawler overstuffed with African migrants fleeing war and poverty was nearing a Sicilian island, not even a quarter-mile away. But it was still dark and no one had yet spotted them. So to signal their position, someone set a match to a blanket.
But rather than sending a signal, the fire brought tragedy when flames from the burning blanket ignited gasoline. Nearly 500 people are estimated to have been on board — including children — and the blaze created a panic that capsized the boat. So close to reaching land, the migrants were now tossed into the sea. Many could not swim.

The EU's executive was on Tuesday expected to push for extra resources to launch sea patrols to cope with the flood of refugees knocking at Europe's doors in the aftermath of the Lampedusa tragedy.

The human exodus from Syria started with a trickle in the latter half of 2011 that became a steady stream in 2012, and turned into a flood in 2013. The UN Refugee Agency (UNHCR) estimates that on average 5,000 Syrians flee their country every day and that by mid-September around 2.1 million were living as refugees, mainly in neighbouring countries. Lebanon alone has taken in 752,000, while Jordan, Turkey, Iraq and Egypt have also accepted hundreds of thousands.

Amnesty Internation is accusing Greece of "blatantly ignoring their obligations" in law by refusing migrants, often fleeing from the conflicts in Syria and Afghanistan.
A new report, Frontier Europe: Human Rights Abuses on Greece's border with Turkey (pdf) shows how the Greek authorities use 'push backs', simply turning away groups of migrants at their border, refusing them the right to have their cases dealt with or challenge their eviction.

“These stories of push-backs are extremely alarming,” said Nicolas Beger, Director of Amnesty International’s European Institutions Office. “Our research indicates that the Greek authorities are regularly returning people, blatantly ignoring their obligations under international and EU law and endangering people’s lives.”

The bird shot gave Chinois his scars. Perched on a Moroccan mountain lit only by the full moon and orange glow from a tiny corner of Europe below, he pulls up a trouser leg to show the holes pockmarking his knee. The metal pellets he managed to dig out are kept in a grubby handkerchief in his pocket. The others remain buried in the young Cameroonian’s flesh, hobbling his walk.
Coils of razor wire caused the badly-healed gash on Rodrigue’s thigh. It is surprising he does not have more: in the three years he has lived on the mountain, he has faced the towering fences, razor wire, pepper spray and pellet guns 13 times in an attempt to get into Melilla, a patch of Spanish territory on the northern Moroccan coast. And 13 times he has failed, picked up by Moroccan police and dumped at the Algerian border, only to trudge back to the slopes of Gurugu and wait for the opportunity to make another dash over one of the few land borders between Africa and Europe. “I will keep trying until I get to Europe,” says the 32-year-old, who is also from Cameroon.
He is one of tens of thousands of migrants and asylum-seekers massing at the gates of Europe. Many are on an illegal quest to breach a border for economic reasons. But joining them are increasing numbers of Syrians, Egyptians, Tunisians and Malians fleeing turmoil at home after the optimism of the Arab Spring turned into a reality of unrest and repression.

Coastguard signals to refugee boat
Some of the Syrians fleeing the conflict in their country have crossed Turkey aiming for Greece, in order to claim asylum in the European Union. But to get there they have to take to boats - and there have been persistent reports of Greek officials pushing them back into Turkish waters, sometimes with fatal results.
"Everything we would do for our families and our fathers, we do the same thing for these people. We bury them in the Islamic way," says Ekrem Serif-Oamadoglou, as he points to 400 freshly dug graves clustered on the remote hillside.
